Identify which claim you are handling

After a collision, you may receive forms about medical expenses and lost earnings as well as correspondence about fault and injuries. Organize documents by insurer, claim number, and purpose. One company addressing part of the matter does not establish that every coverage issue has been resolved.

No-fault and liability have different functions

No-fault may cover certain economic losses for eligible people. A damages claim against another driver raises different questions about fault and injuries. New York applies a serious-injury requirement to certain pain-and-suffering claims. Assessment requires facts and medical records, not merely a diagnosis mentioned in conversation.

Address notices promptly

DFS states that written no-fault notice generally must be given within 30 days of the accident, subject to the permitted justification for late submission. Do not wait until treatment ends to ask about notice. Keep a copy and proof of submission.

Questions for your attorney

Ask which insurer applies, what information is missing, and how to respond to verification requests. Explain whether you were riding a motorcycle, delivering, or working, because those facts may change the analysis. Disclose household insurance and correspondence from prior attorneys. This guide concerns New York; do not automatically apply its rules to a New Jersey accident.
